What is strict liability in dog bite law?

Strict liability is a legal rule under which a dog owner is automatically responsible for injuries their dog inflicts, regardless of whether the dog had previously shown aggression or whether the owner was negligent.

Under strict liability rules, a dog owner bears legal responsibility for any injury their dog causes simply because they own the animal. The injured person does not need to prove the owner knew the dog was dangerous, failed to control it, or acted carelessly. The injury itself is enough to establish liability.

This differs from negligence-based dog bite laws, which require the injured party to show the owner either knew or should have known the dog was vicious. In strict liability jurisdictions, a first bite can trigger owner liability even if no prior incidents or warning signs existed. Texas applies strict liability to dog bite cases under state law, meaning owners cannot escape responsibility by claiming their dog had never harmed anyone before.

Strict liability protects bite victims by removing the burden of proving what the owner knew or did wrong. Instead of investigating the dog's history or the owner's conduct, the focus stays on the fact that the dog caused the injury. This rule applies regardless of whether the dog was on the owner's property, escaped, or was being walked on a leash. Owners may still face additional liability under other legal theories, and dog bite injury lawyers can advise on all available claims in specific situations.
